The judge reached a verdict that Title VII only protects “firing someone simply for being homosexual or transgender,” but that it does not protect transgender or gay people from “harassment”

“In sum, Title VII does not bar workplace employment policies that protect the inherent differences between men and women,”

Judge Kacsmaryk further argued that disparate treatment of transgender employees does not constitute unequal treatment, reasoning that “a male employee must use male facilities like other males”—a statement that erases transgender identity altogether. He extended that logic to dress codes and pronouns, claiming that requiring employees to adhere to clothing standards and pronoun use based on their assigned sex at birth is not discriminatory because it applies “equally” to everyone.

    Judge Kacsmaryk

He’s horrible and he’s fundie lunatic. So - of course - the GOP judge shops and funnels cases to him (and judges like him) where the GOP can basically be 100% certain how they’ll rude.

    Matthew Kacsmaryk

    Notable cases

Conservative groups have strategically chosen to file lawsuits challenging many Biden administration policies in Kacsmaryk’s division. Kacsmaryk is the only federal judge in the Amarillo Division of the Northern District; 95% of lawsuits filed there are assigned to him.

Ninja edit. The Wikipedia page seems like it might be intentionally bland and shitty. If you’re interested in him and judge shopping - you’ll have to find articles.

Not even liberalism, this is just a condemnation of common-law as a concept.

Like, this couldn’t happen in France and France is plenty liberal, but they don’t use court decisions to establish wide standing legal precedent
